Administrative Appeals Tribunal
If an onshore visa application is refused or the current visa is revoked, it can be appealed through the AAT (Administrative Appeals Tribunal).
Visas lodged outside Australia are not eligible for appeal unless they are supported by a local sponsor. During the appeal period, the applicant will automatically be granted Bridging Visa A and will still be allowed to live/work/study in Australia.
Guidance Notes for AAT:
- The applicant shall have the right to file an AAT appeal within 28 days of receipt of the refusal letter
- If the review is successful, AAT will return half of the application fee
- Applicants who do not understand English can apply for a free translator (family and friends cannot provide translation services)
