Partner Visa

The Partner Visa is an immigration route established by the Australian government. Australian citizen or permanent resident or eligible New Zealand citizens sponsor their overseas spouse/ de facto partner to obtain an Australian permanent resident visa to live with them. 2 Categories of partner visa

  • 2. Prospective Marriage Visa (subclass 300)

    Prospective Marriage Visa (Subclass 300) is designed by the Australian government for unmarried couples who are preparing to get married. One of the couples needs to hold Australian permanent residence, Australian citizenship, or Eligible New Zealand Citizen, and wants to sponsor his/her partner to obtain Australian residence through marriage. Prospective Marriage Visa (Subclass 300) is a two-step visa. Applicants need to apply for a 9-month temporary visa firstly. Visa holders need to enter Australia by holding a visa, get married with his/her Australian partner in Australia within the validity period of the visa, and submit onshore partner visa (Subclass 820/801) application. During the duration of the visa, visa holder is allowed to legally live, study, work, travel, enter and leave Australia unlimitedly. · This type of visa is applicable to:  Unmarried couples who intend to go to Australia to get married and live in Australia for a long time. · About the submission method: Only can submit the application outside Australia.  · Visa cost:  AU$8,085 * adjusted annually, the latest cost please check on the official website. · Estimated processing time:  7-29 months * adjusted constantly, the latest processing time please check on the official website. · Visa Results: A 9-month temporary visa
  • 1. Partner Visa (Subclass 309/100, 820/801)

    Partner Visa is an immigration channel designed by the Australian government for one party who holds permanent residence, Australian citizen, or eligible New Zealand Citizen and wants to sponsor the other party to obtain Australian residence.  If there are children under age of 18 in the family who do not have Australian residence can be applied as dependent to obtain Australian residence with main applicant together. Usually, Partner visa is a two-step visa. First step is to apply temporary residence (TR, Subclass309/820). If the relationship is still stable and continuous, the applicant can apply for permanent residence (PR, Subclass 100/801) 2 years after the date he first submit the 309/820 visa application to grant Australian permanent residence. · Consideration key point: The relationship is true, the proof material is complete and true, there is no concealment between each other · This type of visa is applicable to:
    • Married couple;
    • De facto partner with relationship of 12 months or more
    If the de facto relationship is registered in Australia, the requirement of 12-month cohabitation can be exempted · About the submission method:  Depending on whether the applicant is in Australia or not, there are two ways to submit the visa:
    • Onshore Application: Submit a Subclass 820/801 visa application in Australia, applicant is allowed to wait for the visa outcome in Australia by holding a bridging visa, and eligible to apply for a temporary Medicare card;        
    • Offshore Application: Submit a Subclass 309/100 visa application outside Australia, applicant needs to apply for a valid visitor visa to enter Australia while waiting for the outcome, and needs to comply with the visa conditions.        
    Note: Specific submission method will be determined in accordance with the applicant's actual permanent residence and visa conditions. · Visa cost:  AU$8,085 * adjusted annually, the latest cost please check on the official website · Estimated processing time:  About 2 years, depending on the applicant's situation and the documents provided to determine the processing speed. In late 2021, the Australian government announced that applicants and sponsors must provide "learning English through reasonable effort" when applying for permanent residence (PR, Subclass 100/801) visa for partner visa applicants and sponsors. Applicants can meet the requirements in the following ways:
    • Provide an IELTS test result of 4.5 for each band (or other equivalent English tests), or
    • Provide evidence of having completed 500 hours of the AMEP English training program.
    Despite opposition, the policy has failed to materialize. However, from the original intention of adding this requirement, it is the real hope that every new immigrant can smoothly integrate into Australian society and adapt to Australian life in the future.
